Measures of Beijing Municipality on the Administration of Housing Provident Fund Deposit

  Chapter I General Provisions

  Article 1 In order to strengthen the management of housing provident fund deposit and safeguard the legitimate rights and interests of housing provident fund owners, these Measures are formulated in accordance with the Regulations of the State Council Municipality on the Administration of Housing Provident Fund, the Provisions of Beijing Municipal People’s Government on the Implementation of the Regulations on the Administration of Housing Provident Fund, and the relevant provisions of the state and this Municipality, combined with the actual situation of this Municipality.

  Article 2 These Measures shall apply to the deposit management of housing provident fund within the administrative area of Beijing, including:

  (1) Registration, account opening, alteration and cancellation of housing provident fund units;

  (two) the establishment, sealing and transfer of individual accounts of housing provident fund;

  (three) the amount of housing provident fund deposit approved;

  (4) Remittance and payment of housing provident fund;

  (5) Interest calculation, reconciliation and inquiry of housing provident fund.

  Article 3 Beijing Housing Provident Fund Management Committee (hereinafter referred to as the Management Committee) is the decision-making body of housing provident fund management in this Municipality. Perform the following duties in deposit management:

  (a) according to the relevant laws, regulations and policies, formulate and adjust the specific management measures of housing provident fund, and supervise the implementation;

  (two) responsible for formulating the specific deposit ratio of housing provident fund;

  (3) Determine the applicable conditions for reducing the deposit ratio and postponing the payment of housing provident fund, and examine and approve or authorize the examination and approval unit of Beijing Housing Provident Fund Management Center (hereinafter referred to as the Management Center) to apply for reducing the deposit ratio or postponing the payment;

  (four) to determine the upper limit of the deposit amount, and to examine and approve or authorize the management center to examine and approve the application of the unit that exceeds the upper limit of the deposit amount.

  Article 4 The management center shall be responsible for the deposit management of housing provident fund within the administrative area of this Municipality.

  Article 5 The following units and their employees shall pay the housing provident fund:

  (1) State organs;

  (2) State-owned enterprises, urban collective enterprises, foreign-invested enterprises, urban private enterprises and other urban enterprises;

  (3) Institutions;

  (4) Private non-enterprise units;

  (5) Social organizations.

  Other units and their employees can deposit the housing provident fund in accordance with the principle of mutual voluntariness.

  Article 6 On-the-job employees refer to civil servants and employees who have signed employment contracts or labor contracts with their units, or who have not signed contracts but have been identified by the labor arbitration department as having a factual labor relationship for more than six months.

  Article 7 Conditional units may, on the principle of mutual voluntariness, establish housing accumulation funds for employees who have not signed contracts for less than six months.

  Eighth individual industrial and commercial households and freelancers can apply for housing provident fund deposit.

  Ninth before 1993, the standard price preferential measures for the purchase of workers and couples, in line with the following circumstances, the unit should establish housing provident fund for them:

  (a) the sum of the length of service of both husband and wife has reached 65 years and is on the job, and the housing provident fund shall be established from the second month of the husband and wife’s length of service and 65 years;

  (two) according to the standard price preferential measures for the purchase of workers and couples, after paying the house price, According to the Trial Provisions on Housing Adjustment for House-purchasing Employees ([95] Beijing Housing Reform Office No.056), Notice on Printing and Distributing Supplementary Provisions on Housing Adjustment for House-purchasing Employees ([97] Beijing Housing Reform Office No.071) and Notice of Beijing Municipality on Establishing Housing Provident Fund for Employees who Purchase Houses by Preferential Measures at Standard Prices ([98] Beijing Housing Reform Office No.071)

  Chapter II Registration and Account Establishment

  Tenth units should go to the management center for housing provident fund deposit registration.

  The newly established unit shall, within 30 days from the date of establishment, go to the management center for registration of housing provident fund deposit.

  Units handling the registration of housing provident fund deposit should hold a copy of the certificate of legal person, a copy of the business license or the approval document for the establishment of the unit.

  Eleventh units should designate a person to handle the housing provident fund related business.

  The unit manager should hold the power of attorney of the unit and the original ID card to the management center for registration. Need to change the agent, should be timely to the management center for change registration.

  Twelfth units should handle the formalities for the establishment of housing provident fund accounts for employees within 20 days from the date of completing the registration of housing provident fund deposit.

  Units that employ employees shall handle the procedures for the establishment of housing provident fund accounts for employees within 30 days from the date of employment.

  Thirteenth each employee can only have one housing provident fund account.

  Employees employed by institutions and branches of other provinces and cities in Beijing who have not paid housing provident fund shall establish housing provident fund accounts in this city.

  Article 14 If the registration information such as the name and address of the unit is changed, it shall go to the management center to register the change with relevant certification materials within 30 days from the date of the change.

  Fifteenth unit merger, division, cancellation, dissolution or bankruptcy, should be within 30 days from the date of the above situation, the original unit or liquidation organization to the management center for registration of change or cancellation of registration.

  Units handling the registration of change or cancellation of housing provident fund shall issue relevant certification materials.

  Sixteenth employees’ personal registration information, such as name, ID number, etc., is changed, and the relevant certification materials should be used to register the change.

  Chapter III Deposit

  Seventeenth housing provident fund year from July 1st of this year to June 30th of the following year; The housing provident fund year included in the financial budget management unit can be from January 1st to December 31st.

  Article 18 The monthly deposit of housing provident fund shall be adjusted once a year.

  The monthly deposit of housing provident fund consists of two parts: the monthly deposit of employee housing provident fund and the monthly deposit of unit housing provident fund.

  The monthly deposit amount of employee housing provident fund is the average monthly salary of employees multiplied by the deposit ratio of employee housing provident fund.

  The monthly deposit amount of unit housing provident fund is the average monthly salary of employees multiplied by the deposit ratio of unit housing provident fund.

  Article 19 The average monthly salary of employees shall be determined by dividing the total salary of employees from January 1 to December 31 of the previous year by 12.

  The total wages are calculated in accordance with the provisions of the National Bureau of Statistics on conscientiously implementing the provisions on the composition of total wages (No.1 [1990] of the Control Word).

  Article 20 The monthly deposit amount of employee housing provident fund in a new job or transferred to a new unit shall be calculated according to the employee’s monthly salary.

  Twenty-first city housing provident fund deposit ratio, drawn up by the CMC, approved by the Municipal People’s government, announced to the public.

  Article 22 The housing accumulation fund paid by individual employees shall be withheld and remitted from their wages by the unit where they work.

  The unit shall remit the housing provident fund paid by the unit and remitted for the employees to the housing provident fund account opened by the management center in the bank within 5 days from the date of monthly payment of employees’ wages. After the funds are received, the management center will allocate the corresponding funds into the employee housing provident fund personal account.

  New employees began to pay housing provident fund from the second month of their work.

  The newly transferred employees shall pay the housing provident fund from the month when the transferred units pay wages.

  Seconded, expatriate workers, the unit that has established labor relations with the workers is responsible for the implementation of the housing provident fund deposit.

  Article 23 After deducting the monthly contribution of employee housing provident fund, if the employee’s salary is lower than the minimum wage standard published by Beijing Municipal Bureau of Labor and Social Security, the monthly contribution of employee housing provident fund may be reduced to reach the minimum wage standard. The monthly deposit amount of unit housing provident fund remains unchanged.

  If the wages of laid-off workers and retired workers are lower than the basic living expenses of laid-off workers announced by the Beijing Municipal Bureau of Labor and Social Security after deducting the monthly payment of housing provident fund, the monthly payment of housing provident fund for laid-off workers can be reduced to reach the basic living expenses of laid-off workers. The monthly deposit amount of unit housing provident fund remains unchanged.

  Article 24 The upper limit of the monthly deposit of housing provident fund shall be determined by multiplying 300% of the average monthly salary of employees in Beijing in the previous year by the sum of the deposit ratio of housing provident fund of units and employees in that year.

  The implementation period of the upper limit of the monthly deposit of housing provident fund is one housing provident fund year.

  The upper limit of the monthly deposit of housing provident fund shall be adjusted and announced by the CMC in a timely manner.

  Twenty-fifth units over the upper limit of the monthly deposit of housing provident fund, should be approved by the higher authorities or regulatory authorities, and reported to the CMC for approval after the audit of the management center; If there is no superior competent department or regulatory department, it shall be reported to the management Committee for approval after being audited by the management center.

  Twenty-sixth units that have paid the housing provident fund in full by the financial department will no longer be examined and approved if the deposit amount exceeds the upper limit.

  Article 27 The unit shall pay the housing provident fund according to the approved monthly deposit amount, and the underpayment shall be supplemented. After the overpayment is confirmed by the unit and the management center, the unit shall inform the employee himself, deduct the overpayment from the employee housing provident fund account and transfer it back to the paying unit.

  Article 28. Units that have real difficulties in paying the housing provident fund may, after discussion and approval by the workers’ congress or trade union of the unit, handle the reduction of the payment ratio or holdover if there is no workers’ congress or trade union, with the consent of more than two-thirds of all the workers, and after being audited by the management center and reported to the management committee for approval.

  If the average monthly salary of employees in the current year is higher than the average monthly salary of employees in the previous year announced by the statistics department of this Municipality, it shall not apply for reducing the deposit ratio.

  The examination and approval of the application of the unit to reduce the deposit ratio or holdover the housing provident fund shall be completed within 30 days from the date of receiving the application of the unit.

  Article 29 The application period for reducing the deposit ratio or deferring the housing provident fund shall not exceed one year at a time. If the unit cannot resume normal deposit and needs to continue to reduce the deposit ratio or postpone payment, it shall go through the renewal formalities within one month before the expiration.

  Thirtieth units to reduce the deposit ratio, after the economic benefits of the unit improve, should restore the normal housing provident fund deposit ratio.

  The holdover of housing provident fund units should pay the holdover of housing provident fund after the economic benefits of the units improve. Units and employees to terminate the labor relationship, the outstanding housing provident fund should be paid to the employee’s individual housing provident fund account.

  Units that have deferred housing provident fund for three consecutive years may apply for reducing the proportion of housing provident fund deposit during the deferred period.

  Thirty-first units that have not yet established housing provident fund shall go through the deposit registration at the management center, go through the formalities for the establishment of housing provident fund accounts for their employees, and deposit housing provident fund.

  Thirty-second units to repay the previous year’s housing provident fund, should be calculated in accordance with the provisions of the scope and standards of employees.

  For units that have difficulty in calculating the overdue amount, the monthly deposit amount can be calculated according to the average monthly salary of employees of this unit in the previous year of the overdue year or the average monthly salary of employees announced by the statistics department of this Municipality.

  The overdue amount calculated by the unit and the employees respectively shall be paid by the unit to the management center.

  Units that have difficulties in paying back the previous annual housing provident fund may apply for reducing the deposit ratio or holdover after discussion and approval by the staff and workers’ congress or trade union of the unit, and with the consent of more than two-thirds of all the staff and workers, and after being audited by the management center and reported to the management Committee for approval.

  Thirty-third units merger, division, cancellation, dissolution or bankruptcy, should pay the unpaid and underpaid housing provident fund for employees.

  When the unit is merged or divided, if it is unable to pay back, it should be clear about the main body responsible for paying back the housing provident fund before going through the relevant formalities.

  When the unit is revoked, dissolved or bankrupt, it shall pay off the housing provident fund of the unpaid employees in accordance with the relevant provisions of the state and this Municipality.

  When the unit goes bankrupt, the housing accumulation fund of unpaid employees should be regarded as an integral part of employees’ wages and included in the bankruptcy liquidation procedure to give priority to liquidation.

  Chapter IV Sealing up and Transferring

  Thirty-fourth workers and units to temporarily suspend the wage relationship but still retain the labor relationship, the unit should handle the internal storage procedures of housing provident fund for employees.

  Thirty-fifth management center to set up a centralized storage warehouse, the management of the following circumstances:

  (a) the transfer of the original unit or the termination of labor relations with the original unit, and the new unit has not been implemented or the housing provident fund has not been established;

  (two) transferred to other provinces and cities, the unit has not established housing provident fund;

  (three) the unit is revoked, dissolved or bankrupt;

  (four) the employee housing provident fund is sealed in the unit and voluntarily transferred to the centralized storage warehouse;

  (5) Others.

  Thirty-sixth workers housing provident fund into centralized storage management, the unit shall apply to the management center and provide a copy of the employee’s identity certificate.

  Article 37 Under any of the following circumstances, a unit or employee shall go through the formalities for the transfer of individual housing provident fund, and the individual housing provident fund account under the original unit housing provident fund account shall be transferred to the newly transferred unit or centralized storage:

  (a) the workers are transferred to work within the scope of this Municipality;

  (two) workers transferred from the city;

  (3) The unit is merged or divided;

  (four) after the cancellation, dissolution or bankruptcy of the unit, the employee housing provident fund enters the centralized storage management;

  (five) centralized storage warehouse workers and new units to establish labor relations;

  (six) other need to handle the transfer procedures.

  Thirty-eighth units and employees to terminate the labor relationship, the original unit shall, within 30 days from the date of termination of the labor relationship with employees, handle the procedures for the transfer of housing provident fund to centralized storage.

  After the employees form labor relations with the new unit, the new unit shall, within 30 days from the date of establishing labor relations with the employees, handle the transfer procedures of housing provident fund accounts for the employees.

  Article 39 Where a unit is merged, divided, revoked, dissolved or bankrupt, it shall handle the formalities of transfer or centralized storage of housing provident fund accounts for its employees with the audit documents of the management center within 20 days from the date of completing the registration of change or cancellation.

  Article 40 If the unit fails to handle the formalities of sealing and transferring the housing provident fund account for employees, the employees may apply to the management center for urging the unit to handle it with valid certification materials.

  If it is still not handled after being urged, the management center can handle it according to my application.

  Chapter V Reconciliation, Inquiry and Interest Calculation

  Forty-first management center should reconcile with the deposit unit and employees every year.

  Management center in July 31 each year, released to the public housing provident fund reconciliation announcement.

  The management center shall, before August 31st of each year, issue reconciliation vouchers for housing provident fund to the deposit units and employees.

  Forty-second units have the right to inquire about the deposit of housing provident fund of their own units, and the management center shall cooperate.

  Workers have the right to inquire about the deposit of their housing provident fund, and the management center should cooperate.

  Forty-third workers and units have objections to the housing provident fund account deposit, you can apply to the management center for review. The management center shall give a written reply within 5 days from the date of receiving the application.

  Forty-fourth management centers, entrusted banks and related staff should keep the information of employees’ housing provident fund accounts confidential.

  Forty-fifth management center to provide housing provident fund depositors with housing provident fund card or housing provident fund passbook, as a valid certificate of housing provident fund deposit.

  Forty-sixth housing provident fund from the date of deposit in the employee housing provident fund account, according to the interest rate stipulated by the state.

  During the period when the employee housing provident fund account is sealed, the housing provident fund will bear interest as usual.

  Chapter VI Supplementary Provisions

  Article 47 The term referred to in these Measures shall be calculated on working days (excluding legal holidays).

  Article 48 The Beijing Housing Provident Fund Management Center shall be responsible for the interpretation of these Measures.

  Article 49 These Measures shall come into force as of April 1, 2006. The provisions that are inconsistent with these measures shall prevail.

Strengthen top-level design, improve standards and norms, and promote the sustainable and healthy development of "Internet+government services"

  The CPC Central Committee and the State Council attached great importance to the work of "Internet+government services". In April 2016, General Secretary of the Supreme Leader pointed out at the symposium on network security and informatization that it is necessary to promote the modernization of the national governance system and governance capacity through informatization, coordinate the development of e-government, and build an integrated online service platform. Premier Li Keqiang proposed in the government work report of the "two sessions" in 2016 that "Internet+government services" should be vigorously promoted, data sharing among departments should be realized, and residents and the masses should run less errands, handle affairs easily and avoid congestion. In order to strengthen the national integration of "Internet+Government Services" technology and the top-level design and standardization of the service system, according to the unified deployment, the E-government Office of the State Council organized and compiled the "Guide to the Construction of Internet+Government Services" technology system (hereinafter referred to as the "Construction Guide"), which was issued to all regions and departments in the name of the State Council in December 2016. The Construction Guide puts forward the information-based solutions and operation methods to standardize the operation of administrative power and optimize the supply of government services, which is of positive significance for promoting the standardized construction of "Internet+government services" platform in various regions and departments and promoting the sustainable and healthy development of "Internet+government services".

  First, the "Construction Guide" was compiled at the right time

  With the deepening of the transformation of government functions and the development of information technology, online government service has become an important way for the government to provide services to the society and the public, and "Internet+government service" is gradually becoming a new way, new channel and new carrier to innovate government management and service. It can be said that the current promotion of "Internet+government services" is just the right time, with foundation, conditions and motivation. It is a major measure for governments at all levels to deepen reform and actively adapt to the situation. It is of great significance for accelerating the transformation of government functions, improving the efficiency of government services, deepening mass entrepreneurship and innovation, further stimulating market vitality and accelerating the formation of new development momentum.

  Strengthening the national integration of "Internet+government services" technology and the top-level design of service system is not only an important measure to implement the relevant decision-making arrangements in the State Council, but also an urgent need for various regions and departments to promote the work of "Internet+government services". At the same time, the construction of online government service platform in various regions and departments has achieved positive results. However, due to the separate construction, there are great differences between departments and regions, the affairs are not comprehensive, the standardization, fineness and convenience of service information are not high enough, online and offline connectivity is not smooth, cross-regional and cross-departmental information sharing is difficult, business collaboration is difficult, and basic support such as security and identity authentication is insufficient. Many comrades in local departments have reported that the construction of government service technology system is of overall significance. If it is not unified in the top-level design perspective, new information islands and information fragmentation will be formed. It is urgent to strengthen overall planning from the national level and standardize and guide the construction of government service platforms from the technical and content levels.

  In order to implement the spirit of leading comrades’ important instructions on promoting "Internet+government services", the E-government Office of the State Council focused on the construction of "Internet+government services" platform, information sharing, interconnection and other aspects to promote the pilot demonstration and technical system construction of "Internet+government services". First, organize relevant provinces and cities to carry out pilot demonstrations. Since the beginning of 2016, focusing on the outstanding problems in government services, we have organized Jiangsu, Zhejiang, Guizhou, Gansu and Qingdao to carry out the pilot work of "Internet+government services" to solve a number of blocking points and pain points that restrict the whole online service, improve the integrated support capacity of government services, explore effective methods to realize cross-regional and cross-departmental information sharing, and initially establish a clearly classified, objective and comprehensive evaluation and assessment system. The pilot work was fully affirmed by the leading comrades in the State Council, and it also provided examples and experiences for improving the pertinence and operability of the Construction Guide. The second is to organize the preparation of the "Internet+Government Services" technical system construction guide. Compiling the Construction Guide is not only the key task of the Guiding Opinions of the State Council on Accelerating the Work of Internet+Government Services, but also the key link of the work of Internet+Government Services. The compilation of "Construction Guide" lasted for nearly one year, and received strong support from various regions and departments. We tried to put forward the implementation path and operation method around the last mile of "Internet+government service" from the perspective of the role of informatization through the compilation of the guide.

  Two, the preparation of the "Construction Guide" is a process of building consensus and solving difficult problems.

  (A) the main preparation process

  The E-government Office of the State Council officially started the compilation of the Construction Guide in January 2016. First, a working mechanism with extensive participation of relevant parties has been established. Invite the heads of five local government service agencies and e-government agencies in Jiangsu, Zhejiang, Guizhou, Gansu and Qingdao to set up special working groups; Set up an overall group led by the State-run E-government Office and an expert group composed of experts in e-government related fields; Invite research institutions such as National School of Administration and National Information Center as supporting units; Establish normal working contact with the central network information office, development and reform commission and other functional departments. The second is to carry out in-depth research and discussion exchanges. Organized a technical training and exchange meeting for the construction of "Internet+Government Services" platform for 31 provinces (autonomous regions and municipalities directly under the Central Government); Held a centralized research meeting attended by 10 regions including Beijing, Shanghai, Fujian and Guangdong; Go to relevant areas to carry out field research; Relying on the "Internet+Government Services" series forums of the National School of Administration, some local departments and experts were organized to hold special seminars. Through extensive investigation, we have a comprehensive understanding of the experience, practices and existing problems of various departments in various regions, as well as opinions and suggestions on the compilation of the guide. The third is to combine the pilot demonstration work and key technology research, comprehensively sort out and summarize the current situation and common problems of government services in various regions and departments, and fully absorb the achievements and experiences of exploration and practice in promoting the construction of government service halls and online government service platforms in Beijing, Shanghai, Jiangsu, Zhejiang, Fujian, Guangdong, Hainan, Guizhou, Gansu, Ningxia, Shenzhen, Qingdao, Nanjing and other regions.Organize forces to focus on tackling key problems and prepare the first draft of the Construction Guide. The fourth is to solicit opinions from relevant localities, departments and experts. It has held many expert argumentation meetings, local department symposiums and consultation meetings, and solicited opinions from local departments in writing after the first draft was formed. According to the opinions and suggestions of various departments in various regions, it has been revised and improved many times.

  (B) several principles to grasp in the preparation work

  First, adhere to the problem orientation. In view of the difficulties, pain points and blocking points in online government service, such as nonstandard content, inconvenient service, non-interoperability of online government service platforms, non-sharing of data, poor online and offline connectivity, and insufficient standardization of government service, this paper deeply analyzes the reasons, studies and formulates solutions, optimizes the government service structure, improves the construction mechanism, and strives to break through the information barrier. The second is to strengthen the top-level design. According to the requirements of national chess game and local conditions, do a good job in the top-level design of "Internet+government services" and gradually establish technical standards and management norms covering all aspects of the whole process of "Internet+government services". The third is to promote resource integration. Make full use of existing facilities and data resources, optimize and improve the construction level of existing government service platforms in various regions and departments, so as to make up the position and avoid starting a new stove. Guided by norms and supported by platforms, we will give full play to the role of public "channels" and common support, and promote cross-regional, cross-departmental and cross-disciplinary information sharing and business collaboration. The fourth is to pay attention to open collaboration. Make full use of Internet thinking, government and social forces, fully absorb the practical results of pioneering regional exploration, take into account the development reality of different regions, and provide different construction modes and application depth versions for various regions and departments to choose according to the actual situation, focusing on popularization, replication and sustainability, and striving to highlight operability, iteration and foresight.

  (3) The key problems to be solved in the guide

  Focusing on solving the outstanding problems existing in the "streamline administration, delegate power, strengthen regulation and improve services", such as the difficulty in handling affairs, examination and approval, running errands, and many certificates, the Construction Guide focuses on the key links of "Internet+government services" business support, basic platforms, key technologies, evaluation and assessment, clarifies the technical framework and service specifications, and formulates technical schemes, management methods and standards for promoting cross-regional and cross-departmental platform interoperability, mutual recognition of licenses, and data exchange. Strengthen the top-level design and standardization of the national integrated "Internet+government service" system, promote the cracking of "information islands" and "data chimneys", so that information can "run more roads" and enterprises and the masses can "run less errands". First, in order to solve the problems of incomplete, irregular and inconvenient online affairs, standardize the construction of business support system, promote the standardization of matters list, work guide, detailed review, collaborative business handling and dynamic management of matters; Second, in view of the problems of non-interoperability and data sharing of online government service platforms, strengthen the construction of basic platform system, realize unified declaration, unified acceptance, centralized handling, unified feedback and whole process supervision of government services, and promote platform integration and data sharing; Third, in view of the general technical obstacles to the development of online government services, improve the construction of key support technology systems, and promote the construction of unified online identity authentication, unified electronic license database, and the application of big data and cloud computing in government services; Fourth, in view of the lack of user experience and evaluation methods of government services, we will promote the construction of evaluation and assessment system, and promote the improvement of government services with electronic monitoring and third-party evaluation as the starting point.

  Third, strengthen overall planning, form a joint force, and promote the implementation of the "Construction Guide"

  Promoting "Internet+Government Services" is a systematic project involving the overall situation and far-reaching influence, and it is also a pioneering work. In the next step, in accordance with the decision-making arrangements of the CPC Central Committee and the State Council on promoting "Internet+government services", we will work closely with the relevant departments of the State Council and various departments in various regions, focusing on implementing the Guiding Opinions of the State Council on Accelerating the Work of "Internet+Government Services" and the Notice of the General Office of the State Council on Printing and Distributing the Guide for the Construction of the Technical System of "Internet+Government Services", and strive to reshape this relationship’s government functions and make it practical and convenient.   In order to deepen the reform of the fiscal and taxation system and accelerate the establishment of a modern financial system, according to the requirements of "Opinions of the State Council on Reforming and Perfecting the Central-local Transfer Payment System" (Guo Fa [2014] No.71), we now put forward the following implementation opinions on reforming and perfecting the provincial-level financial transfer payment system.
  I. General requirements

  (1) Work objectives. In accordance with the decision-making arrangements of the CPC Central Committee, the State Council, the provincial party committee and the provincial government, with the main goal of promoting regional coordinated development and equalization of basic public services, we will deepen the reform of fiscal and taxation system below the provincial level, increase transfer payments, optimize the transfer payment structure, standardize the allocation and use of funds, strengthen supervision and management and performance evaluation, establish and improve a scientific, standardized and unified provincial financial transfer payment system, improve the balance of financial distribution between regions and levels, and promote the sustained and healthy development of the province’s economy and society.
  (2) Basic principles.
  1. Adhere to the problem orientation and clarify the subject of responsibility. In view of the main problems existing in the current financial transfer payment system, carefully study and formulate measures to solve them, and ensure that the transfer payment system is connected with the reasonable division of powers and expenditure responsibilities. Strengthen the function of promoting the equalization of basic public services as a whole at the provincial level, and clarify the main responsibility of cities and counties to make good use of superior transfer payments to promote economic and social development.
  2. Adhere to the sinking of financial resources and ensure the development of grassroots units. Adhere to the principle of "suppressing the level and protecting the grassroots" and further increase the transfer payment from the province to cities and counties. Efforts will be made to clean up and integrate special transfer payments, improve the stable growth mechanism of general transfer payments, and promote the development of county economy.

  Second, optimize and adjust the transfer payment structure

  (1) Adjust the transfer payment structure in combination with the division of powers. On the basis of reasonably dividing the powers and expenditure responsibilities of governments at all levels, we will optimize and adjust the transfer payment structure. In addition to the powers assumed by the central government in accordance with the regulations, if it belongs to the provincial powers, the province shall bear the full expenditure responsibility, and in principle, it shall be organized and implemented by the province through the expenditure arrangement at the provincial level; Belong to the province and the city and county share the power, by the province and the city and county share the responsibility of expenditure, the province share part can be entrusted to the city and county through special transfer payment; Belonging to the city and county, the city and county shall bear the responsibility for expenditure. In underdeveloped areas, cities and counties bear the financial gap in expenditure responsibility, and the province mainly gives appropriate support through general transfer payments, and a small number of guiding, relief and emergency affairs can be supported through special transfer payments.
  (2) Increase the proportion of general transfer payments. Further reduce special transfer payments, expand general transfer payments, and enhance the overall planning ability of cities and counties. Strive to increase the proportion of general transfer payment of provincial finance to 60% or above before the end of 2015, and keep it at a high level in future years. Gradually form a transfer payment structure with a balanced distribution of financial resources between regions and general transfer payments arranged and used by the municipal and county governments as the main body, and a reasonable and appropriate proportion of general transfer payments and special transfer payments.
  (3) Expand the scale of transfer payments. Further increase the transfer payment from the province to cities and counties, give preferential support to underdeveloped areas and grassroots governments, and promote the horizontal and vertical financial structure balance in the province. Through the transfer payment to less developed areas, we will improve the balance of expenditure between regions, gradually increase the proportion of expenditure in the eastern and western regions of Guangdong Province to the total expenditure at the prefecture (county) level, and further promote the revitalization and development of the eastern and western regions of Guangdong Province.   Third, improve the general transfer payment system

  (1) Improve the general transfer payment system. In accordance with the principle of combining "basic protection" with "strong incentives", a general transfer payment system with indemnificatory transfer payment, incentive transfer payment, transfer payment in ecological areas and transfer payment in special difficult areas will be established and improved. The total amount of affordable transfer payments, transfer payments in ecological areas and transfer payments in areas with special difficulties should be kept above 60% of general transfer payments.

The balanced transfer payment base, fixed amount subsidy, settlement subsidy and general transfer payment with special purpose will be included in the scope of guaranteed transfer payment. Guaranteed transfer payment is oriented to "guarantee the basics", ensuring the vested interests of cities and counties, and ensuring the financial needs of cities and counties in underdeveloped areas to provide basic public services and maintain the normal operation of political power.
  (3) Strengthen the guiding effect of incentive transfer payment. We will implement incentive transfer payment mechanisms such as coordinated development awards and fiscal revenue increase awards, and constantly improve system design and factor indicators in light of the development of the economic and social situation. Incentive transfer payment is guided by "strong incentives", focusing on the key work arrangements of the provincial party Committee and the provincial government, stimulating and mobilizing the enthusiasm of cities and counties, and guiding cities and counties to complete the objectives and tasks of "stabilizing growth, adjusting structure, promoting reform, benefiting people’s livelihood and preventing risks".
  (4) Improve the transfer payment in ecological areas.   Four, clean up and standardize the special transfer payment

  (1) Clean up and integrate the existing special transfer payment items. Special transfer payments that do not meet the requirements of economic and social development, have no reasonable basis for examination and approval, are found to be inefficient in the use of funds through performance evaluation, or are found to be obviously illegal in financial supervision and audit inspection, and are resolutely revoked. In combination with the reform of the tax and fee system, the provisions on urban maintenance and construction tax, sewage charges, the price of exploration and mining rights, mineral resources compensation fees and other special funds will be gradually abolished, and funds in related fields will be arranged as a whole. For the special transfer payment whose establishment period has expired and the original policy objectives and tasks have been completed, the provisions on recovery at maturity shall be strictly implemented. We will integrate the special transfer payments that are scattered, have similar goals, use similar directions, support similar objects, and have similar fund management methods. Strictly control the number of special fund projects managed by provincial departments, and reduce the special funds of provincial general public budget to less than 60 by 2016 according to the principle of "one department and one special project, no special project and no new special project". Establish and improve the regular evaluation and withdrawal mechanism for special transfer payment projects that really need to be retained.
  (2) Strictly control the newly established special transfer payment projects. In addition to the transfer payment projects explicitly required by the state, in principle, no new special transfer payment projects will be established at the provincial level. If it is really necessary to establish a new provincial special transfer payment project, it is necessary to conduct a feasibility study and put forward a clear performance target in accordance with the regulations, and report it to the provincial finance department for examination and approval, and then report it to the provincial government for examination and approval. The newly-established special projects should have clear policy basis, policy objectives, fund demand, fund use, implementation plan, annual fund arrangement, establishment period, performance objectives, competent departments and division of responsibilities, and establish a regular evaluation and withdrawal mechanism accordingly. The budget of special transfer payment funds shall be "fixed for one year", and the arrangement shall not be solidified. If it still needs to be arranged after the expiration, it shall be submitted for approval according to the procedures after performance evaluation and special audit.
  (3) Gradually withdraw from the competitive field. Any special transfer payment that is "small, scattered and chaotic", has no obvious effect and can be effectively adjusted by the market competition mechanism, will be resolutely cancelled. For the special transfer payments in competitive fields that have been introduced due to price reform and macro-control, the implementation period should be clearly defined and cancelled upon expiration. For the reserved competitive fields with certain externalities, we should control the scale of funds, highlight the key points of protection, gradually change the administrative distribution mode, mainly adopt market-oriented operation modes such as fund management, and gradually combine with financial capital to play a leverage role in inciting social capital. For a few people who are not suitable to implement the fund management model, we should take subsidy methods such as discount, construction first and subsidy afterwards, insurance premium subsidy, guarantee subsidy, etc. on the premise of clarifying the subsidy mechanism in advance, so as to prevent problems such as vague subsidy mechanism, difficulty in implementation or taking subsidy funds.
  (4) Standardize the measures for the management of special funds. There should be only one fund management method for each special transfer payment. If there are multiple fund management methods for a special project, it should be integrated and merged, and no special project should be added in disguise. The fund management measures should define the policy objectives, division of responsibilities among departments, objects of fund subsidies, scope of fund use, methods of fund allocation, procedures of fund allocation, requirements of supervision and inspection and performance management, information disclosure, etc., and gradually meet the requirements of unified distribution subjects, consistent distribution methods and unique application and approval procedures. If it is necessary to issue a project declaration guide or a declaration notice, it should be made clear in the fund management measures. Subsidies should be set according to policy objectives and classified according to government agencies, institutions, individuals and enterprises, so as to facilitate supervision and inspection and performance evaluation.
  (five) gradually cancel the city and county funding requirements. On the basis of a reasonable division of the powers and expenditure responsibilities of governments at all levels, except that the provinces and cities and counties share the powers according to regulations, the provinces no longer require the cities and counties to bear matching funds when arranging special transfer payments. The expenditure responsibility shared by provinces, cities and counties should be based on public welfare, externalities and other factors to clarify the standard or proportion of sharing expenditure responsibility by governments at all levels below the provincial level. According to the local financial situation, the same special project can be divided into different regions, and the sharing ratio of different special projects to the same region should be gradually unified and standardized.
  Five, standardize the allocation of transfer payment funds

  (1) Explore the establishment of a linkage mechanism between transfer payment and urbanization of agricultural transfer population. Establish and improve the dynamic management and information sharing mechanism of agricultural transfer population, and strengthen the statistics of agricultural transfer population and the policy of citizenization. For general transfer payments and special transfer payments that are distributed according to the factor method and the benefit scope involves local residents, factors such as the permanent population of cities and counties should be considered when allocating funds, and they should be appropriately linked to the citizenization of local agricultural transfer population, which objectively reflects the basic public service expenditure needs of cities and counties. When allocating funds by using other relevant indicators related to the per capita level, the population should be calculated by considering the data of permanent population, registered population and financially supported population.
  (2) Improve the allocation of general transfer payment funds. In principle, the general transfer payment adopts factor method and formulaic distribution, scientifically sets the factors and weights of distribution, fully considers the nature of transfer payment and the actual situation of each region, and promotes the balanced distribution of financial resources between regions and the equalization of basic public services. Affordable transfer payments and transfer payments in areas with special difficulties mainly adopt indicators such as the per capita disposable financial resources level of cities and counties, the per capita general public budget expenditure level, and the demand for basic financial resources, as well as objective factors such as population and jurisdiction area. Incentive transfer payment can be targeted to set up an assessment index system, which is appropriately linked to the promotion of coordinated development of local economy, society and ecology and the strengthening of financial management in cities and counties, and the allocation of transfer payment funds can be calculated in combination with the results of supervision and inspection and performance evaluation in the previous year.
  (3) Standardizing the allocation of special transfer payment funds. Strict special transfer payment funds allocation requirements, clear departmental responsibilities, social organizations, industry associations, enterprises and institutions and other non-administrative organs shall not be responsible for the allocation of funds. Special transfer payments are generally allocated by project method or factor method. For major projects, investment projects across cities, counties and river basins, and key projects with strong selectivity, competitiveness and externalities, the project method is mainly adopted for allocation, project library management is implemented, the subject, scope and conditions of project declaration are defined, the project declaration process is standardized, professional organizations and experts are brought into play, and the supervision and balance mechanism is improved. For the projects with the advantages of regional management information, we mainly adopt the factor method to allocate, select objective factors, determine reasonable weights, calculate according to the scientific and standardized allocation formula, cut them into pieces and distribute them to cities and counties, and decompose them into subsidy objects according to regulations. For special projects related to the vital interests of the masses, the administrative distribution mode can be changed, and the distribution mechanism of government guidance, social organization evaluation and mass participation can be gradually promoted.
  Six, strengthen the transfer payment budget management

  (1) Strengthen budget preparation. General transfer payments are budgeted according to the basic standards and calculation methods stipulated by the central and provincial governments; Special transfer payments shall be budgeted by project and region. The financial transfer payment issued by the provincial government must be included in the budget management of the city and county governments, accurately included in the relevant revenue and expenditure accounts, and reported by the city and county governments to the people’s congresses at the same level or their standing committees according to regulations.

  (3) Promoting information disclosure. The budget arrangement and implementation of the provincial financial transfer payment should be explained in the annual budget report submitted to the provincial people’s congress for deliberation, and made public within 20 days after the provincial people’s congress approved the budget, and explained the important matters; The municipal and county governments shall explain the management and use of transfer payment funds from higher levels in the annual budget and final accounts report submitted to the people’s congress at the same level for deliberation, and make it public in a timely manner. In addition to confidentiality requirements, financial departments at all levels should take the initiative to disclose the establishment basis, management methods, fund scale, distribution results, purpose items, users, performance evaluation, supervision and inspection, audit results and other information of financial transfer payment to the public.
  (four) to strengthen the overall planning of government fund budget and general public budget. The general public budget can no longer arrange or reduce the arrangements for projects that are budgeted by government funds. The special transfer payment arranged by the government fund budget and the general public budget at the same time should be regarded as a special project in specific management, and a unified fund management method should be formulated and a unified fund distribution method should be implemented.
  Seven, strengthen the supervision and inspection of transfer payment funds and performance evaluation.

  (a) establish and improve the supervision and inspection system. Gradually expand the scope of performance evaluation of transfer payment funds.   Eight, accelerate the relevant supporting reforms.
